Mother Killed Who Was 32 Weeks Pregnant, But Washington Says Her Unborn Baby Girl Isn’t a Human Being
There likely will be no justice in Washington state for a viable, late-term unborn baby who died when her mother was murdered in a “random act of violence” in Seattle.
On June 13, a convicted felon named Cordell Maurice Goosby, 30, allegedly shot Eina Kwon at an intersection as she was driving to work, killing both her and her unborn baby, Law & Crime reports. Kwon’s husband and 3-year-old son survive.
Goosby is facing a first-degree murder charge as well as an attempted murder charge for allegedly shooting Kwon’s husband, Sung, who is recovering from his injuries. Goosby pleaded not guilty to both charges Thursday, the Seattle Times reports.
However, he probably will not face any legal consequences for allegedly killing the Kwons’ unborn daughter who was 32 weeks along, nearly full term, according to the report.

The King County Prosecuting Attorney’s Office said Washington state law does not recognize unborn victims of violence.
“We are committed to ensuring justice for each victim in this case. Under Washington State law, a person can be only charged with homicide for the death of a person who was ‘born alive,’” the office said June 16. “The medical records are still being reviewed by the King County Medical Examiner’s Office, Seattle Police investigators and King County prosecutors.”
Last week, county spokesperson Casey McNerthney said they have not yet determined if charges can be filed in the baby’s death, according to the Seattle Times.
The Kwons, owners of the Aburiya Bento House restaurant in Belltown, were driving to work June 13 when the shooting occurred, authorities said.
“In this case, the defendant broke in a run with a weapon and ran towards the victims’ car with gun outstretched. In a short span of time he fired a gun in the victim’s car window, striking the victims inside the car. After firing all the bullets he had in the gun into the victims’ car, he turned and ran from the scene, throwing the murder weapon down as he ran,” according to court documents. “The defendant’s actions left a family and community shattered.”
Prosecutors described the crime as a “senseless and seemingly random act of violence.”
Local news reports described how the crime has rocked the local community, with Seattle Mayor Bruce Harrell and others promising to crack down on gun violence.
Harrell is a pro-abortion Democrat, but he mentioned the Kwons’ unborn daughter in his statement lamenting the violence.
“What was supposed to be a joyful time for the Kwon family has turned into an unimaginable nightmare caused by senseless gun violence,” the mayor said in a June 15 statement. “This tragedy is horrific in so many ways – we have lost a mother and unborn child from an act of unprovoked violence.”
Yet, Democrats like Harrell refuse to legally recognize unborn babies as valuable human beings or provide justice to their families.
Even aside from abortion, violence against unborn babies and pregnant mothers is pervasive. Homicide is one of the top causes of death among pregnant women, according to a 2021 study in the journal “Obstetrics & Gynecology.” In some cases, the violence is directly related to the pregnancy. LifeNews has documented numerous crime stories in which pregnant women were abused or killed because they refused their partner’s demands to abort their unborn baby.
Washington state is not alone in its neglect of unborn victims of violence. Other Democrat-controlled states, including New York and Colorado, also refuse to provide justice for unborn victims of crimes because such laws may interfere with their pro-abortion agenda.
New York lawmakers repealed their fetal homicide law in 2019 as part of a larger pro-abortion bill. Just a few weeks later, a pregnant woman was stabbed in Queens, killing her and her five-month unborn baby.
Police said the attacker targeted Jennifer Irigoyen’s torso, possibly in a direct attempt to kill her unborn baby. However, authorities said they were forced to drop charges related to the unborn baby’s death because of the legislature’s action.
In Colorado, where abortions are legal for any reason up to birth, state lawmakers also refused to enact protections for unborn babies – even after a brutal 2015 crime in which a woman cut a seven-month unborn baby girl out of her mother’s womb.
Illinois also repealed its fetal homicide law in 2019.
Most states do provide justice to unborn victims of violence in at least some circumstances. Now that Roe v. Wade is gone, 15 states protect unborn babies by banning or strictly limiting elective abortions, and more are fighting in court to do the same.
Other states allow the “choice” to violently end an unborn baby’s life in an abortion, but do provide legal exceptions when the violence is not a choice by the mother.
More than 30 states allow charges to be filed against defendants who injure or kill unborn babies in criminal acts, according to the National Right to Life Committee. The federal Unborn Victims of Violence Act, enacted in 2004, also provides justice to unborn victims of federal and military crimes.
