19 Attorneys General Challenge Biden Attempt to Change HIPAA Rules to Promote Abortion
Tennessee Attorney General Jonathan Skrmetti and 18 other state Attorneys General are challenging a new rule Joe Biden has proposed to promote abortions nationwide.
Biden officials are quietly working on another new pro-abortion regulation, one that could thwart state authorities’ ability to investigate abortionists who kill unborn babies in violation of their pro-life laws. The proposed regulation from the U.S. Department of Health and Human Services (HHS) Office of Civil Rights would use HIPAA patient privacy law to stop investigations of illegal abortionists.
The department portrays the proposed rule change as an effort to protect the privacy of women seeking abortions, but really it could interfere with state authorities’ ability to protect unborn babies and mothers from abortionists who break the law.
“HHS does not have authority to change the law in contradiction of the statute passed by Congress,” Skrmetti said.
According to a news report, the 19 state Attorneys General are challenging the proposed rule.
Mississippi Attorney General Lynn Fitch issued the letter to the Secretary of Health and Human Services (HHS) on Sunday with signatures of support from Tennessee AG Skrmetti and other Attorneys General from Kentucky, Alabama, Indiana, Alaska, Louisiana, Arkansas, Missouri, Georgia, Montana, Idaho, Nebraska, North Dakota, Ohio, Texas, South Carolina, Utah, and South Dakota.

The Attorneys General argue following the Supreme Court’s decision putting decisions on abortion in state’s hands rather than being federally protected, states such as Tennessee where abortion is illegal should have the right to obtain information on procedures where citizens circumvent state laws. The letter states the rule “would unlawfully interfere with States’ authority to enforce their laws, and does not serve any legitimate need. Relying as it does on a false view of state regulation of abortion, the proposed rule is a solution in search of a problem,” the letter reads.
The letter goes on to state “The Administration, however, has pushed a false narrative that States are seeking to treat pregnant women as criminals or punish medical personnel who provide lifesaving care. Based on this lie, the Administration has sought to wrest control over abortion back from the people in defiance of the Constitution and Dobbs. The proposed rule here continues that effort.”
Currently, it is common for law enforcement agencies to obtain certain healthcare information in these circumstances. As the letter states, “For over 20 years, HHS regulations have safeguarded the privacy of individual health information while permitting disclosure of information to state authorities to protect public health, safety, and welfare. The proposed rule would upset that careful, decades-old balance.”
The letter calls for the proposed HHS rule to be withdrawn, calling it the “Administration’s efforts to override state abortion laws.”
