'If Trump's lawyers complain he’s got too many indictments, maybe he should stop criming': MSNBC host
MSNBC host Katie Phang had a suggestion for former President Donald Trump as he laments he has too many legal woes to deal with.
The long-time legal analyst was asked about Trump's attorneys writing: "The defendants believe there should be simply no secret said nor any facts concealed from the public view relative to the prosecution of a leading presidential candidate by his political opponent. Our democracy demands no less than full transparency."
Phang explained it was not blackmail but a kind of "graymail."
"It's this idea that Donald Trump is trying to threaten Jack Smith by saying, fine, you want to play, let's play," she continued. "And we're going to sit there and make sure that the American public sees all of this classified information. But underestimate somebody like special counsel Jack Smith. This is not his first time at the rodeo. He knows exactly what he's handling when it comes to classified document litigation. He knows what's at stake here. And if you think Jack Smith and his team have not considered the ramifications of having to present a case wherein the prosecution carries the burden of proof beyond and to the exclusion of every reasonable duty, then you've underestimated it, to the detriment, if you're Donald Trump."
She also explained that the Classified Informations Procedures Act (CIPA) is "exquisitely clear" when it comes to the "timing of the hearing, objections and challenges designations made by the DOJ."
"It's not the first time this is being litigated," she said. There's a reason why a statute exists to be able to follow. So, today, Aileen Cannon will get a continued lesson from the DOJ. Not only from its very detailed filings of it but from the prosecutors today telling the judge, this is how it's supposed to be done. You're gonna be able to handle this and you're able to do it post-haste. There's no reason to delay it any further.
"If Trump's lawyers are complaining he has other indictments, well then maybe he should stop criming and he can face only one indictment at a time. In this instance, the more the merrier."
