Georgia judge sets date to hear challenges from Trump and several co-defendants
Judge Scott McAfee has scheduled a slate of new hearings for Donald Trump and several of his co-defendants in the Georgia election interference case.
Lawfare's Anna Bower reported that the hearings, scheduled for Dec. 1, appeared on the court's docket Thursday.
Donald Trump's attorneys made several motions to dismiss charges, and others came from former Georgia GOP chair David Shafer and Bob Cheeley, who gave lawmakers the videos of ballot counting. The third co-defendant scheduled for the hearing is Ray Smith, who participated in a Georgia state Senate hearing in Dec. 2020, claiming there was widespread fraud and that the results “must be vacated and cannot be allowed to stand.”

Among Trump's demands is that his indictment is removed due to the Supremacy Clause and a variety of demurs. The claim under the Supremacy Clause is that, since federal law supersedes state laws, the Georgia case is illegitimate.
Two demurs – a legal term meaning to raise doubts or objections – deal with Count 1, which is a "violation of the Georgia RICO (Racketeer Influenced and Corrupt Organizations) Act."
He also included demurs to Counts 9, 11, 13, 15, 17 and 19.
Nine is the conspiracy to commit impersonating a public officer.
Eleven is the conspiracy to commit forgery in the first degree.
Thirteen is the conspiracy to commit false statements and writings.
Fifteen is the conspiracy to commit filing false documents.
Seventeen is the conspiracy to commit forgery in the first degree.
Nineteen is the conspiracy to commit false statements and writings.
