Ex-prosecutor: How long before Donald Trump violates the federal gag order?
Donald Trump used his First Amendment rights to claim he was having his First Amendment rights violated by President Joe Biden's administration.
In one of his many rants on social media Sunday, Trump claimed, The Corrupt Biden Administration just took away my First Amendment Right To Free Speech. NOT CONSTITUTIONAL!"
What Trump was talking about is the gag order in the federal case where Trump has been indicted for an attempt to overthrow the 2020 election.
Judge Tanya Chutkan reinstated the gag order on Sunday evening after Trump attacked his former chief of staff, Mark Meadows after it was reported he made an immunity deal with special counsel Jack Smith. Trump's lawyers filed an appeal for the first time the gag order was ordered, and Chutkan put it on hold while she considered a stay of the gag order during that appeal.
Speaking to MSNBC on Sunday evening, former federal prosecutor Glenn Kirschner explained that it probably didn't do Trump any favors that right after the gag order was paused, he proved why the gag order was necessary.
POLL: Should Trump be allowed to run for office?
"What did he do? He started saying and posting things that if the gag order remained in place, would have been direct violations of that gag order," Kirschner explained. "So, we saw that at 7:05 p.m. Eastern Time today, she reimposed the gag order. She entered a summary entry on the public document. It's called a minute order. I suspect we may see more complete written orders from her soon saying she is reimposing the original gag order."
Kirschner also said that it's interesting this was put back in place at a time that former Vice President Mike Pence dropped out of the race. Trump has mostly targeted somewhat viable foes against him like Gov. Ron DeSantis (R-FL), limiting his attacks on Pence.
"It seems like [Pence] will now be included in that prohibition because he is now simply a witness who will be testifying undoubtedly had Donald Trump's criminal trial, because Trump waged a relentless campaign against Mike Pence trying to get him to violate the law, the Electoral Count Act," continued Kirschner.
"So now, the only question that remains is how long before Donald Trump violates the reimposed gag order?" he asked.
