Fan Sues Ex-Cubs Slugger Jorge Soler
OK, so at first your initial inclination might be to simply think this is a money-grab from the fan, but man, this is just a sucky situation and I do feel bad for her. Is she going to win? That’s going to be the tough part because Mayra Norris filed a lawsuit against the Atlanta Braves and ex-Cubs slugger Jorge Soler, who she alleges caused, “significant and excruciating injuries,” after getting hit by a ball that Soler threw into the stands during a game in the 2021 World Series.
According to the lawsuit the injuries included, “multiple fractures, a right eye edema and infra-orbital abrasion.”
The Braves have given a public statement about the case. Via 11alive.com.
We are aware of the recent lawsuit filed by Mr. and Mrs. Norris against the Atlanta Braves and Jorge Soler. Mrs. Norris’ injury was not due to any negligence on the part of Jorge Soler, the Braves, or anyone affiliated with our organization. We intend to answer and deny the claims, and immediately move for the court to dismiss the case based on the legal precedent that has clearly and unwaveringly been set not only in Georgia, but across the country.
The complaint alleges that Soler threw the ball into the stands overhand and, “with a great deal of speed and force.”
However, although you may never actually read anything that’s on your ticket, even on the digital version, there is always a general disclaimer about things flying into the stands and that everyone is assuming risk by going to the game.
Even if Soler did hurl a ball fast into the stands, I think it’s going to be hard to prove he was intentionally throwing it directly at this fan. Again, if you read the lawsuit and the injuries, it truly does suck, but this kind of seems like those shitty situations where this fan simply had the worst luck of her life.
“Over the past two years, Ms. Norris has been forced to seek extensive medical treatment for her injuries. She is still under the care of a physician and will be for some time,” said Susan B. Shaw with Susan B. Shaw Law LLC, who represents Norris.
On top of the injuries, the fan’s marriage has also suffered with the lawsuit claiming, she and her husband “have had their marital relationship interfered with” with the husband suffering “a loss of companionship and affection with his wife.”
