Police shoot Oakland man who allegedly tried to run them over with SUV

TRACY – Officers shot and injured a 39-year-old Oakland man Sunday morning in Tracy after he allegedly tried to run them over with a stolen SUV, according to authorities.

The shooting happened around 3:30 a.m. at a Best Buy warehouse in the 6000 block of Hopkins Road.

Officers were initially called to the warehouse for a report of multiple individuals breaking into parked trailers, the Tracy Police Department said in a statement Tuesday.

An investigation by Tracy police, the San Joaquin County District Attorney’s Office and the California Department of Justice determined that Sergio Garibay “used a vehicle and attempted to run over two uniformed Tracy police officers to avoid apprehension,” according to police. The officers opened fire, hitting Garibay several times.

Garibay was taken to a hospital, where he was listed in stable but critical condition.

No other injuries were reported.

Following his release from the hospital, Garibay will be booked into San Joaquin County jail on charges of assault with a deadly weapon on an officer, burglary and conspiracy, police said.

Officers arrested two other occupants of the SUV, according to police. A 27-year-old woman and a 36-year-old man, both of Oakland, were booked on charges of burglary and conspiracy. The man was also booked on a charge of resisting arrest.

A fourth suspect escaped on foot, police said. No other arrests were announced Tuesday.

The Infiniti QX30 that Garibay was driving at the time of the shooting had been reported stolen to the San Jose Police Department, according to police.
