The latest batch of newly unsealed court documents related to Jeffrey Epstein's prolific sex trafficking scheme includes a highly-anticipated 2016 deposition from Virginia Roberts Giuffre.

In it, she details her allegations of sexual abuse against the now-dead financier, as well as individuals she said participated in trafficking her, including powerhouse lawyer Alan Dershowitz.

Dershowitz, one of many high-profile figures Giuffre alleged she had sex with while she was being trafficked by Jeffrey Epstein, has repeatedly denied ever having sex with her. For years, he has litigated and publicly called for unsealing all documents related to the case, stating in numerous media interviews that the documents would prove he had done nothing wrong.

On Tuesday, after the documents were unsealed, Dershowitz told Business Insider "the material that has come out is completely exculpatory of me," adding: "I'm a complete victim of a total frame up."

Giuffre's claims against Dershowitz

The unsealed deposition is related to a defamation case between Dershowitz and Giuffre's lawyers, Paul Cassell and Brad Edwards. Cassell and Edwards filed suit against Dershowitz in 2015, claiming Dershowitz had defamed them by alleging they knowingly filed a case that contained falsehoods about Dershowitz or failed to adequately investigate Giuffre's claims against the celebrity lawyer.

In the deposition, Giuffre alleges that she and Dershowitz were introduced while Jeffrey Epstein trafficked her as a teenager. She alleges she and Dershowitz had sex on "at least six" occasions, saying that she couldn't count the number of times she'd met the then-Harvard law professor.

"Professor Dershowitz was around a lot and there was always young girls around a lot," Giuffre says in the deposition.

She describes several instances of engaging in sexual contact with Dershowitz, who's now 85, or when he was nearby, indicating "Dershowitz was so comfortable with the sex that was going on that on one occasion he observed me in sexual activity with Epstein."

Giuffre details in the deposition being encouraged by Epstein to engage in oral sex with Dershowitz while in a limousine, to have intercourse in a plane while traveling with another young woman who was trafficked by the financier, and at Epstein's home in his bedroom.

"After the sexual experiences, which is what I had been trained to do anyway, which was not out of the ordinary, I went to the back of the plane, got washcloths, and proceeded to clean Jeffrey and Dershowitz up with a warm washcloth," Giuffre testified.

In addition to accusing Dershowitz of engaging in sex with her while she was between the ages of 17 and 18 years old, Giuffre also alleged in the deposition that she had seen him having sex with at least one more of Epstein's victims she suspected of being underage, a girl she identified as "blond" and "young."

Giuffre also indicates in her testimony that she told several people about her experiences with Dershowitz, including a friend to whom she characterized the professor as a "pedophile."

Edwards' and Cassell's suit against Dershowitz settled in 2016.

Dershowitz attacked Giuffre's credibility

Dershowitz has maintained his innocence, calling Guiffre a "certified, complete, total liar" who "simply made up the entire story for money" in comments to the press from 2015-2018.

Following their 2016 settlement, Cassell filed a brief identifying the work that he and Edwards had done to ensure her claims against Dershowitz were credible.

Cassell, in the 2016 filing, pointed to a Palm Beach Police report, flight logs, the fact that another lawsuit had accused "academicians" of having sex with Epstein witnesses, and other depositions and records tying Dershowitz to Epstein and Guiffre. He said the settlement didn't mean Giuffre's claims weren't true.

In his own affidavit to support his motion to unseal the Epstein records, Dershowitz wrote 27 pages battling back against Cassell and repeatedly denied ever having sex with Guiffre or having even been at any of Epstein's properties during the same two-year period she was associated with him.

Guiffre wasn't the only woman to say Epstein directed her to have sex with Dershowitz. Sarah Ransome made a similar allegation in documents that surfaced in court records, claiming Dershowitz was one of Epstein's friends he directed her to have sex with.

In a court filing seeking to discredit Ransome, Dershowitz filed emails from her where she characterizes her allegations in ways that appear politically motivated, and includes claims that appear outlandish. She said, amid the 2016 election, that the CIA hacked her emails and that she "reached out to the Russians for help" and planned to "take down" both Trump and Clinton with the help of Wikileaks.

While Ransome has recanted some of her claims about Epstein — such as the allegation that he had recordings of his powerful friends having sex in his homes — she hasn't withdrawn her allegations about Dershowitz. Ransome didn't immediately respond to Business Insider's request for comment.

"While much of the Cassell Declaration goes far beyond what is reasonably required to respond to the instant motion, and while it surely has the distinct air of 'protesting too much,' I cannot stand mute in the face of this continuing assault on my character," Dershowitz wrote. "As this declaration and the accompanying reply brief will demonstrate, the charges against me are baseless, and unsealing the Requested Document is the only proper response to Ms. Giuffre's efforts to smear me through the legal process."

Guiffre sued Dershowitz for defamation in 2019, alleging his vehement denials of her claims tarnished her reputation. He countersued for defamation, beginning a lengthy back-and-forth battle between the pair, ultimately ending in a settlement at the end of 2022.

After Dershowitz entered into a settlement with Guiffre in 2022, she told reporters that she "may have made a mistake" in identifying him as one of her abusers.

Dershowitz said the settlement "exonerated" him. But in a statement later to The Daily Beast, Giuffre disputed that characterization.

"Stopping the false charges against me, and securing Mr. Dershowitz's public acknowledgement of my good faith was important to me and my family," she said. "However, I did not, and would never, 'exonerate' Mr. Dershowitz in return."

To Dershowitz, 'the case is over'

Since their settlement, Dershowitz has softened his public statements regarding Guiffre while maintaining his innocence regarding her allegations.

When news that the related court documents would be unsealed, Dershowitz publicly called for the complete release of all related documents, claiming they'd prove his innocence.

Speaking to BI after Guiffre's deposition was unsealed, Dershowitz said, "you have to look at all the exculpatory evidence and understand that I was framed."

He added: "I've had sex with one woman since the day I met Jefferey Epstein till the day he died: My wife. And there's not a scintilla of evidence to suggest otherwise. I have all my travel records to prove I couldn't have been at any of the places she said she met me. And that's why she basically settled the case."

The unsealed deposition, Dershowitz told BI "shows the origin" of how he came to be "framed" for crimes against Guiffre.

"Virginia Giuffre had never heard of me," Dershowitz said. "She called Sharon Churcher, the journalist from the British tabloid, and said, 'Tell me the names of people who I had sex with' because she didn't remember. And Churcher said, 'Well, we know there's no proof about Alan Dershowitz. But you have to put him in your book because he's famous.'"

In the 2011 email — which was made public years ago, and also appears in the newly unsealed documents — Churcher talks to Giuffre about a book project the accuser had been working on. Churcher broke the story for The Daily Mail about Giuffre being trafficked by Epstein. When Giuffre asked her for book advice, Churcher told her "Don't forget Alan Dershowitz."

"We all suspect Alan is a pedo and although there's no proof of that, you probably met him when you were hanging out with JE," Churcher wrote.

In the deposition, though, Giuffre does not indicate Churcher directed her to identify Dershowitz, instead saying: "I was given a picture to look at and he asked me which ones that I recognized as abusers and Alan Dershowitz was one of those."

Guiffre added in her testimony: "I just identified him. I don't think we actually got into any kind of details. It was going through a book of people kind of like the FBI does and pointing out. She was more interested in Prince Andrew."

Dershowitz points to the 2022 settlement as an indication that he has been vindicated and there's no more reason to look into Guiffre's claims or his ties to Epstein.

"As far as I'm concerned, the case is over. That's the end of it. Let's go on with our lives. So that's my position: The case is over. She's admitted she may have confused me with somebody else, and you know, I've been exculpated 100%."
