President Trump Should Drop This Biden Pro-Abortion Lawsuit
President Trump can brag about a lot of economic victories in his first few months back in office. The wins keep coming and there is a good chance that some new trade deals are cut that will both help domestic manufacturing while allowing exporters to get a fair deal.
There also is the “Big Beautiful Bill” that extended long-term tax cuts and otherwise bolstered the economy. There are major trade deals with Japan and the European Union and the repositioning of America atop the energy markets. And nobody should forget the efforts to end the Biden-era regulation-by-lawsuit crusade that targeted companies under questionable and sometimes flatly false pretenses.
Most of these victories have been won. Now Trump needs to finish the job when it comes to reversing how federal actions from the previous administration are holding companies back from hiring, growing and otherwise contributing as much as possible to the economy.
In his first term, Trump’s business deregulation measures spurred one of the most impressive eras of economic growth Americans have ever seen. The economy was enjoying quarters of 4% growth and household income rose $5,500 during the first term.

Unfortunately, much of that halted thanks to the Covid-19 pandemic and the Biden administration’s proclivity for politically motivated litigation and regulatory enforcement. For example, the Biden White House launched legal actions against PepsiCo and Microsoft that were frivolous in nature and eventually were dropped.
The administration also sued eBay for allowing products to be sold that didn’t fit the Biden administration’s global warming crusade, but the Trump administration dropped that one earlier this summer.
But the job is not done. In 2022, Kochava, an Idaho-based data collection firm, was sued by the Biden administration for allegedly collecting geolocation data that could be used to identify who was going to abortion clinics.
No one had actually used the data for this purpose, or even thought to do so. But it was a few months after Roe v. Wade was overturned, and the Biden administration was looking for scapegoats. The lawsuit was filed for no other reason than to score political points.
That’s not just my opinion. The administration knew that Kochava was already taking steps to protect data by collecting it away from sensitive places. But the administration didn’t care – they needed to make an example out of someone to fit the political points surrounding the issue of abortion.
Not surprisingly, the FTC could never fully define what constituted “sensitive” activities, but it did issue a press release with a long list of things that “could” happen with this type of data. It was clearly selective, using politically motivated lawfare instead of sticking with established standards that would apply to all tech companies for protecting consumers and their sensitive data.
This regulation-by-lawsuit only punishes innovation and does little to address consumers’ needs. That’s why Trump should push his FTC to drop the lawsuit against Kochava and other companies still in the legal crosshairs. Not only would doing so end a period of politically motivated prosecution by the federal government, but it would be another form of deregulation for opening up more business growth by a) reducing fear of persecution, and b) allowing targeted companies to put legal, financial, and leadership resources towards hiring and growth instead of court appearances.
Trump’s recent track record has helped take government brakes off of America’s economic engine and spurred new levels of investor confidence as reflected by the months-long run in the stock market. Taking this next step will only strengthen the already significant momentum and help usher in more economic growth through the rest of the decade.
