Former SMPD officer shot and killed by San Marcos police early Christmas morning
A man was shot and killed by San Marcos police early Christmas morning, according to the city.
SAN MARCOS, Texas (KXAN) -- A former San Marcos police officer was shot and killed by San Marcos police early Christmas morning, according to the city.
The City of San Marcos reported just after midnight, police were called to the Grand at Stonecreek apartments near I-35 and East McCarty Lane.
They said a woman called 911 and told dispatchers there was an assault in an apartment at the complex. They said the man allegedly responsible, later identified as Kyle Lobo, 36, was drinking and had a gun.
When police got there, they said Lobo had a kid in his arms. He handed that child to the female caller, then drew his gun, according to the City of San Marcos. That's when they say they shot Lobo.
He was taken to Ascension Seton Hays where he was pronounced dead, it said.
"There was ambulance and stuff coming and other paramedics so at that point I went out. As soon as I turned my hallway corner I saw the caution tape," a neighbor told us. "Unthinkable. It was just sad."
KXAN has previously reported that Lobo resigned from the San Marcos Police Department earlier this year amid family violence charges. The city confirmed it's the same man.
According to arrest warrants, Lobo's wife told officers he had assaulted her five or six times since the start of 2022, including times when he allegedly assaulted the woman's 11-year-old son.
The Texas Rangers are investigating the fatal shooting. The officers involved will be put on administrative leave, as is policy, the city said.
