Hayward man gets 30 months for possessing gun during shootout

D’Monieya Deshaun Green, 30, has survived five different shootings, and his lawyer says he plans to leave the Bay Area for a safer community.

OAKLAND — A Hayward man was sentenced to 30 months in federal prison for allegedly firing back at an assailant in 2022, six months after he was released from a prior federal prison sentence for gun possession.

D’Monieya Deshaun Green, 30, has now survived five separate shootings. But the birth of his son in late 2022 has given him a new outlook on life, his attorney, Miranda Kane, wrote in court papers.

“Mr. Green is more motivated than ever to break this cycle of gun possession and incarceration. He is determined to be present in his son’s life, unlike his own father,” Kane wrote. “Mr. Green recognizes that his best hope is to move out of the East Bay, to a safer community where he is not in constant fear for his life and where he has an opportunity to make a fresh start.”

Green was charged in federal court last year with being a felon in possession of a firearm and having 20 bindles of heroin for sale. He pleaded guilty to the gun charge in a deal with federal prosecutors, and was sentenced to 30 months and three years of supervised release last month.

Police say that in April 2022, Green fired back at an assailant who sprayed gunfire at him in Oakland. The incident took place six months after Green was released from a two-year federal prison sentence from a 2020 case.

In 2020, Green pleaded guilty to being a felon in possession of a firearm and heroin distribution. That case stemmed from him selling heroin to a police informant in 2018, and firing back at someone who shot at him in May 2019, according to court records.
