Upon the petition at the state tribunal, Justice Dipeolu had in October upheld the election of the former Senate president. Not satisfied with the verdict, Onjeh appealed the case which eventually led to the nullification of the election and a rerun ordered.
A rerun was conducted after the Appeal Court annulled the March 28, 2015 election of which Mark was declared winner by the Independent National Electoral Commission.
Mark won the rerun and was declared winner.
Onjeh approached the court, challenging the election of Mark and praying to be declared winner of the election.
