Worked for a company for 15 years, and left just over a month ago.
Had my P45 and no holiday pay, only had a day off this year.
Spoke to ex boss, who said they will sort it out for me. Few weeks passed no news.
Spoke to my old boss a second time, and they came out with some bull about they only owe me 2 days, as the holiday start dates run inline with the tax year April to March
In all the 15 years I worked there, this has never been the case, its always been Jan to December. Our financial year was also December, I can not believe
after all the years I have put in there, they are doing this.
They are only a small family run company, only 4 of us.
They wont have my contract after all these years, and I have missed placed mine ( not that it said anything about holiday start dates anyway )
If I go to a tribunal, will they have to prove their claims or will I have to prove it ?
What's stopping them from writing a new contract and putting an old date on it, or writing a letter saying the holiday start date has changed and saying we gave him this letter.
Holiday's were just put in a diary, and weren't siged by both parties
Any sensible advice appreciated
